1. Introduction

These terms apply to all services and products provided by NarraTyx (hereinafter: 'we' or 'the organization') to you as an organization (hereinafter: 'the Customer'). NarraTyx is an AI-powered platform that translates personal stories into insights for individual and organizational development. By using our services, you agree to these terms.

2. Definitions

Service(s): The NarraTyx platform and associated software, dashboards, and reports, including AI-powered analyses of personal and team data.

Customer: Any legal entity that uses the NarraTyx platform or has access to the services.

Personal Stories/Data: All information that a user enters into the NarraTyx platform about personal identity, experiences, talents, beliefs, and values.

Agreement: The agreement between you and us regarding the provision and use of the services.

3. Applicability

These terms apply to all offers, orders, and use of the NarraTyx platform by organizations. Deviations or supplementary agreements are only valid if confirmed in writing by NarraTyx.

4. Use of the NarraTyx platform

The Customer receives a license to use the NarraTyx platform as described in the agreement. It is prohibited to copy, reverse-engineer, or otherwise exploit the software without written permission.
The Customer is responsible for the proper use of the platform and for the entry of correct data by employees and users within the organization.

5. Prices and payment

All prices are exclusive of VAT, unless otherwise stated. Payment must be made via the method and conditions agreed upon in the agreement. In the event of late payment, we are entitled to charge statutory interest and collection costs.

6. Delivery and performance

The NarraTyx platform is made available on a software-as-a-service basis.
We strive for availability and correct operation, but we do not guarantee uninterrupted or error-free use.
We are not liable for temporary disruptions or maintenance periods. 7. Privacy and data protection

NarraTyx processes personal data strictly in accordance with the GDPR and our Privacy Statement.
Personal stories/data of employees are used exclusively for analysis and reporting within the platform and are not shared with third parties without the organization's consent.

The Customer consents to the collection and processing of employees' personal data for the purpose of gaining insights at the individual, team, and organizational level.

8. Intellectual property

All rights to the NarraTyx platform, the software, the methodology, the analyses, the dashboards, and the reports belong to NarraTyx or its licensors. The Customer has a limited, non-exclusive license for internal use as described in the agreement.

9. Liability

We are not liable for decisions made by the organization based on insights or analyses from the NarraTyx platform. Direct damage resulting from errors in the platform is limited to the amount paid out under the insurance or the invoice amount for the relevant service.

We are not liable for indirect damage, consequential damage, or loss of profit.

10. Force majeure

Force majeure includes circumstances beyond our reasonable control, such as technical failures, pandemics, natural disasters, or problems with suppliers. In the event of force majeure, obligations will be suspended without liability for any damage.

11. Complaints and disputes

Complaints can be submitted in writing or electronically to service@narratyx.com
We aim to resolve complaints within 14 days. Disputes will initially be resolved through mutual consultation. If this is not possible, the competent court in the Netherlands has jurisdiction.

12. Applicable law

These terms are governed by Dutch law.
For organizations within the EU, the legislation of the country of establishment may also apply.

13. Changes

NarraTyx reserves the right to amend these terms. Changes will be published on the website and will take effect upon publication.
